editurauniversitară.ro – is the trade name of SC EDITURA UNIVERSITARĂ SRL, a legal entity of Romanian nationality, with its registered office at Bd. Nicolae Bălcescu no. 27-33, Bucharest, with serial number in the Trade Register J40/29211/1994, unique tax registration code RO7726230.
Seller – editurauniversitară.ro or any partner of editurauniversitară.ro.
Buyer – natural person / legal entity who creates an Account on the Site or/and places an Order.
Client – natural person / legal entity who has or obtains access to the CONTENT, through a means of communication made available by editurauniversitară.ro (electronic, telephone, etc.) or based on an existing user agreement between editurauniversitară.ro and it and which requires the creation and use of an ACCOUNT.
User – the natural person / legal entity registered on the Site, who, by completing the process of creating his/her Account, as a visiting buyer, has agreed to the site-specific clauses in the Terms and Conditions section.
Account – the section of the Site consisting of an e-mail address and a password that allows the Buyer to submit the Order and which contains information about the Client / Buyer and the Buyer's history on the Site.
Site – the domain www.editurauniversitara.ro.
Order – an electronic document that acts as a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, through the Site, his/her intention to purchase Goods and Services from the Site.
Goods and Services – any product or service to be provided by the Seller to the Buyer as a result of his/her request / order.
Campaign – the action of displaying for commercial purposes, a finite number of Goods and/or Services with a limited and predefined stock, for a limited period of time established by the Seller.
Contract – represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.
Content
• all information on the Site that can be visited or viewed;
• the content of any e-mail sent to Buyers by the Seller by electronic means and/or any other available means of communication;
• information related to the Goods, Services and/or tariffs charged by the Seller in a certain period;
• information related to the Goods, Services and/or tariffs charged by a third party with whom the Seller has concluded partnership contracts, in a certain period;
• data relating to the Seller or other privileged data thereof.
Review – a written evaluation by the owner or beneficiary of a product or service.
Rating – a way of expressing the degree of satisfaction of a User / Client / Buyer with a product.
Comment – critical assessment or observation, on the basis of a Review or other comment.
Question – a form of addressing other Users / Customers / Buyers in order to obtain information about the products or services on the respective page.
Answer – written information that is sent to the Buyer / User / Customer who asked a question on the Site.
Newsletter – a means of periodic information, exclusively electronic, on the Goods and Services and/or promotions carried out by the Seller in a certain period, without any commitment from the Seller with reference to the information contained therein.
Transaction – the collection or reimbursement of an amount resulting from the sale of a Good and/or Service by editurauniversitara.ro to the Buyer, by using the services of the card processor approved by the Seller, regardless of the delivery method.
Specifications – all specifications and/or descriptions of the Goods and Services as specified in their description.
TERMS OF USE
The use, visit and purchase of products on the website www.editurauniversitara.ro implies acceptance of the following terms and conditions:
1. PROTECTION OF PERSONAL DATA
The data processing conditions are those specified in the Privacy Policy section on the website, as well as those contained in contractual clauses, as appropriate
2. CONTRACTUAL DOCUMENTS
2.1. By registering an Order on the Website, the Buyer agrees to the form of communication (telephone or e-mail) through which the University Publishing House carries out its commercial operations.
2.2. The notification received by the Buyer, after placing the Order, has an informational role and does not represent acceptance of the Order. This notification is made electronically (e-mail).
2.3. For justified reasons, the University Publishing House reserves the right to modify the quantity of Goods in the Order. If this happens, the Buyer will be notified at the e-mail address or telephone number provided when placing the Order and will return the amount, if it has already been paid.
2.4. The contract is considered concluded between the Seller and the Buyer when the Buyer receives from the Seller, via email or SMS, the notification of shipment of the Order.
3. ONLINE SALES POLICY
3.1. Access to place an Order is allowed to any Client/Buyer.
3.2. Communication with the University Publishing House can be achieved through direct interaction or through the addresses mentioned in the “Contact” section of the Site.
3.3. All prices for the Goods presented on the Site are expressed in lei (RON) and include VAT.
3.4. In the case of online payments, Editura Universitara is not/cannot be held responsible for any additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the issuing bank of his card, if the currency of issue differs from RON. The Buyer is solely responsible for this action.
4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The entire content of this site is the property of SC EDITURA UNIVERSITARA SRL, its associates or partners and is protected under the Copyright Law and other intellectual property laws.
The combination thereof is the exclusive property of EDITURA UNIVERSITARA SRL and is protected by the same laws. The use without written consent of any of the elements listed above is punishable under the laws in force.
5. ORDER
5.1. The Customer/Buyer can place Orders on the Site by adding the desired Goods to the shopping cart, and then finalizing the Order by choosing one of the indicated payment methods. Once added to the shopping cart, a Good is available for purchase to the extent that there is stock available for it. Adding it to the shopping cart, in the absence of the Order being finalized, does not entail the registration of an order, implicitly, nor the automatic reservation of the Good.
5.2. By finalizing the Order, the Buyer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the Order.
5.3. By finalizing the Order, the Buyer agrees that the Seller may contact him, in any situation in which it is necessary to contact the Buyer.
5.4. The Seller may cancel the Order placed by the Buyer, following a prior notification to the Buyer, without any subsequent obligation of either party to the other or without any party being able to claim damages from the other in the following cases:
- non-acceptance by the issuing bank of the Buyer's card of the transaction, in the case of online payment;
- invalidation of the transaction by the card processor approved by editurauniversitara.ro in the case of online payment;
- the data provided by the Client/Buyer on the Site are incomplete and/or incorrect.
5.5. The Buyer has the right to return a Good, within 15 calendar days, without invoking any reason and without incurring any costs other than delivery costs.
Thus, according to OUG no. 34/2014, the period for returning a Good or waiving a Service expires within 15 days from the day the Buyer enters into physical possession of the last Good – in case the Buyer orders multiple products that will be delivered separately in a single order.
5.6. If the Buyer decides to make a return, he/she may contact us by phone at 0745 200 357, between 08:00 and 16:00, Monday to Friday (except public holidays), to express his/her intention OR he/she may send an email to [email protected]. 5.7. In the event that a Good ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Client/Buyer of this fact and will return to the Buyer's account the value of the Good within a maximum of 3 (three) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed his intention to terminate the Contract.
5.8. The availability of a Good will be displayed on the Site as follows:
- “in stock” – we have more than two copies in editurauniversitara.ro stock
- “out of stock” – the book is no longer available in editurauniversitara.ro stock.
6. BILLING / PAYMENT
6.1. The prices of the books displayed on the website ww.editurauniversitara.ro include VAT according to the legislation in force.
6.2. The price and payment method are specified in each Order. The Seller will issue an invoice to the Buyer, the Buyer's obligation being to provide all the information necessary for issuing the invoice in accordance with the legislation in force.
6.3. The Seller will send the Buyer the invoice related to the Order, in electronic/physical format, to the e-mail address mentioned by the Buyer and/or in the package.
6.4. For the correct communication of the invoice related to the Order, the Buyer is obliged to update his/her data in his/her Account and to access the information and documents related to each Order, existing in the Account.
6.5. The payment card data of the Client/User/Buyer will not be accessible to editurauniversitara.ro nor will they be stored by editurauniversitara.ro or by the payment processor integrated into the Site, but only by the institution authorizing the Transaction or another entity authorized to provide card identification data storage services, about whose identity the Client/User/Buyer will be informed, prior to entering the data.
The entity authorized to provide card data storage services is NETOPIA SRL, a company registered in Bucharest under registration number RO15565496, J40/9170/2003, with its registered office in Bucharest.
6.6. In certain cases, to maintain the security of the Transactions, upon registration of the Order, the Buyer will be asked to authorize the payment by re-entering the password related to the Account or using the fingerprint in the case of mobile terminals that have this facility.
6.7. For Transaction security reasons, the Client/User/Buyer is advised not to remain logged in to the Site and not to set the automatic login option on mobile devices. Disclosing the account access password is not allowed and it is recommended to use a strong Security password.
6.8. In the case of orders registered with the cash on delivery payment method, a one-time order processing cost of 5 lei is added, a cost that will be highlighted separately in the shopping cart and on the tax invoice. The processing cost of orders registered with the “Cash on delivery” payment method is independent of the cost associated with the delivery of the products, which takes into account the final value of the order, this not being taken into account
7. DELIVERY OF GOODS
7.1. Editura Universitara undertakes to deliver the Goods by courier or orders can be picked up directly from our headquarters, according to the Client's option.
7.2. The University Publishing House will ensure the proper packaging of the Goods and will ensure the transmission of the accompanying documents.
8. LIABILITY
8.1. The Seller cannot be held liable for damages of any kind that the Buyer or any third party may suffer as a result of the Seller's fulfillment of any of its obligations under the Order and for damages resulting from the use of the Goods after delivery and, in particular, for their loss.
8.2. By creating and using the Account, the Customer / User / Buyer assumes responsibility for maintaining the confidentiality of the Account data (username and password) and for managing access to the Account, and, to the extent permitted by applicable law, is responsible for the activity carried out through his Account.
8.3. By creating the Account and/or using the Content and/or placing Orders, the Client / User / Buyer expressly and unequivocally accepts the Terms and Conditions of the Site in the latest updated version that is communicated within the Site, existing on the date of creating the Account and/or using the Content and/or on the date of placing the Order.
8.4. After creating the Account, using the Content is equivalent to accepting the changes made to the Terms and Conditions of the Site and/or the updated versions of the Terms and Conditions of the Site.
8.5. The Terms and Conditions of the Site may be modified at any time by editurauniversitara.ro, and they are enforceable against the Clients / Users / Buyers from the date of display on the Site.
9. FORCE MAJEURE
9.1. Neither party shall be liable for failure to perform its contractual obligations if such failure to perform on time and/or properly, in whole or in part, is the result of a force majeure event. Force majeure is an unforeseeable event, beyond the control of the parties and which cannot be avoided.
9.2. If within 15 (fifteen) days from the date of its occurrence, the respective event does not cease, each party shall have the right to notify the other party of the full termination of the Contract without any of them being able to claim any other damages from the other.
10. GENERAL NOTES
We are not liable for defects due to the server on which the site is hosted or for problems caused by the functionality of the Internet connection.
Any attempt at unauthorized access to this site and any attempt at fraud will be reported to the competent authorities.
Any conflict arising between EDITURA UNIVERSITARA and clients is attempted to be resolved amicably through agreement between the two parties. If this is not possible, the Romanian legal provisions in this field will apply.
