Civil procedure is one of the great pillars of law, guaranteeing the rule of law, rights and liberties. Procedural law, whether civil or criminal, plays an important role in the formation of a lawyer. Knowledge base of this discipline is established during the course faculty and reinforce the practice of law. Understand the concept that operates civil procedural law is indispensable for the implementation of substantive law.

This paper presents the most important parts of the general theory of civil procedure. Systematization of the work is based on traditionalist concept that has as a starting point in treating procedural matter, the notion of process and its fundamental principles, continuing with the civil action, participants in the process, power, procedural documents, deadlines and procedural sanctions.

The novelty of this paper is to address procedural theory from the perspective of the New Code of Civil Procedure adopted by Law 134 of 15 July 2010, but neintrat in force. Each institution is treated in parallel, the analysis is performed on both the current legislative provisions, and on those who will come into force soon.

This formula is designed to facilitate familiarization exposure and rapid acquisition of new procedural provisions, but to form an overall opinion on key legislative changes.

The work benefits from current case law, rich and diverse, making it an accessible and effective means of documentation. I opted for a form of writing concise as it was desirable to avoid such abundance of legal information to distract from the purpose, namely the establishment of a useful teaching tool.
